Terms and Conditions

1. General Aspects 

The domain www.bbst.courses, as well as its subdomains belong to the company ALTOM CONSULTING SRL (hereinafter referred to as ALTOM), with headquarters for office activities in Cluj-Napoca, 28 Avram Iancu Street, mezzanine floor, Cluj county, Tax Code RO24111715, J12/2808/2008, https://bbst.courses, email contact@bbst.courses   

This page is addressed exclusively to visitors over 18 years old. 

ALTOM can periodically change the Terms and Conditions (T&C). Any update of these T&C shall be notified to the members and clients by email or by a warning visible on the website, the modified version being accessible through the webpage and applicable from the moment of notification to any Visitor/Client/Student of the services provided.  

The visitor or the client commits to permanently monitor the T&C that can be updated, changed, and completed. In case of conflicts, the terms and conditions available at their occurrence between the parties are applicable, respectively at the notification date of the conflict made by the Visitor, Client, or Student, in writing, to ALTOM. 

Visitor – represents the person who accesses, visits, or sees the content of the website https://bbst.courses. 

Client – represents the visitor who filled in the order form and who purchased and paid one of the services provided by ALTOM in the conditions set out below.  

Student – represents the visitor/client or natural person who participates effectively in the purchased course and who has access to the account created on the online platform where the Educational Program is held and has access to the material. 

Educational Program (EP) – may include courses, workshops, webinars, training sessions organised online or face-to-face.

2. Acceptance of the Terms and Conditions (T&C) 

By accessing and using the website https://bbst.courses you express your consent regarding the following T&C which regulate the contractual relationship between you and ALTOM. 

Accessing the website, registering for purchasing a course, and/or the usage of the services provided through the website https://bbst.courses represent your express consent for accepting these T&C, which regulate the contractual relationship between you and ALTOM.  

By accessing the website, its contents and the services – the Visitor, Client, or Student takes the responsibility for any material, intellectual, or any other type of damages caused by ALTOM to him/her or any of his/her third parties by using/accessing non-compliantly the website, the content or the services.  

If the Visitor, Client or Student does not accept and/or revokes the expressed consent regarding these T&C’s, she/he gives up on the right to access the website, its content, and the services provided by ALTOM through the domain https://bbst.courses.  

Once the Visitor, Client, or Student revokes the consent regarding these terms and conditions, thus giving up on the services provided through https://bbst.courses, ALTOM cannot be held liable by a Visitor/Client/Student who uses the website or the content, without complying with these terms and conditions.  

If a person considers that fragments of the content posted on the website infringe one of his/her rights, he/she can contact ALTOM for details using the contact information published on the website.  

ALTOM is not responsible for the content of other websites accessed by the Visitor/Client/Student using connections (links) existent on the website or in the content of the communication with ALTOM.  

3. Copyright  

The content of this website, inclusively, but not limited to: the logos, styled representations, trade symbols, static images, dynamic images, multimedia text, and/or content presented on the website, are the exclusive intellectual property of ALTOM, having reserved all the rights on the basis of Copyright law no. 8/1996 with the subsequent amendments, as well as all the other laws, including, but not limited to, the applicable laws regarding industrial and intellectual ownership.  

The Visitor, Client, or Student is not allowed to copy, share, publish, transfer to third parties, modify and/or alter, use, expose, or include any content of the website, nor to participate in the transfer, sale, distribution of materials made through the reproduction, modification or display of the content, only with the express consent of ALTOM. 

Any content of the website to which the Visitor, Client, or Student has and/or obtains access by any means, falls within these terms and conditions. 

The Visitor, Client, or Student can copy, transfer, and/or use the content of the website only for personal or non-commercial purposes AND ONLY if it does not conflict with the provisions of these T&C or other applicable Policies.  

It is forbidden to use the content of the website for other purposes than those expressly allowed by these T&C or by another usage agreement, if it is the case. 

As per the educational program materials made available on the e-learning platforms, they are protected by copyright, as they are regulated by the Intellectual Property Policy available on the platform, which the Student expressly accepts.   

4. Policy on accessing the products made available on https://bbst.courses

Through the website https://bbst.courses, ALTOM makes available a series of online courses, and other Educational Programs in accordance with the description from the website, through which ALTOM ensures the training of the Students – who register and attend them. 

The purchase and registration to an Educational Program is made by filling in the order form available for the visitors on https://bbst.courses. Depending on the type of program, this shall be carried out using the Canvas online platform or other e-learning platforms. The deadline for registration to an Educational Program is 1 day prior to the commencement.

A Student has to successfully complete the BBST® Foundations course in order to be able to participate in the BBST® Bug Advocacy or BBST® Test Design courses. In order to be able to participate in the BBST® Domain Testing course, the Student has to successfully complete the BBST® Test Design course. 

After purchasing an Educational Program and paying for it using one of the payment options offered on the website, the appointed Student who shall participate effectively in the chosen Educational Program shall receive via email the instructions to access the designated e-learning platform.  

The Educational Programs shall be held online by our trainers with whom we collaborate and who were brought to your attention at the moment of purchasing the Educational Program. We reserve the right to change, remove, or add other instructors if the situation requires it, from the list of instructors associated with the educational program, published on the website. We guarantee that all modifications are made to ensure the highest quality possible.

 If the course is successfully completed in accordance with the course requirements, the Student receives a certificate of completion. 

The certificate of completion shall be sent to the provided email address and shall also be available online by accessing a link which shall be known only by ALTOM, the course instructors and the Student.  

All the Educational Programs, additional materials, and discussions shall be held in English. ALTOM commits to ensuring all members access to the accounts created on the e-learning platforms, to providing the human resources required for the deployment of the Educational Programs made available, and to ensuring each Student the support and all the additional materials necessary for the deployment of the Educational Program. 

ALTOM cannot guarantee the Student’s level of assimilation of the materials in the Educational Programs. In order to ensure the highest chances of successfully completing a course, the trainees have to comply with the requirements of the course, respectively to log into the e-learning platform several times a week, at least 1-2 hours a day; to finish all the received tasks in accordance with the requirements; to read and reply on time to all the emails related to the course; to participate at the discussions associated with the course or indicated by the trainer and to request help when and if necessary.   

The price owed by the Client for the selected Educational Program is provided expressly when filling in the order form. The price does not include VAT. The price shall be paid by the Client by electronic means made available through the online payment method available on www.plationline.ro or by Wire Transfer on the basis of the payment details provided by ALTOM.  

If the Student chooses to give up on participation in the purchased  Educational Program, she/he is obliged to notify the cancellation of registration at least 5 working days prior to its commencement. In this case, ALTOM shall refund the Client 95% of the paid price, the amount of 5% being retained with the title of administrative fees.  

If the cancellation of the participation for the  Educational Program is not made in compliance with the minimum period of 5 working days prior to the course, ALTOM shall retain the entire paid price, but the registration remains available, the Student having the possibility to participate in the next similar educational program made available.  

If the cancellation of the participation for the  Educational Program is made after the course/workshop has begun the price shall not be refunded and the registration does not remain available for the next similar course/workshop. 

If the Client purchased a Specialization and the Student does not complete successfully one of the courses, he/she can retake the uncompleted course after its repurchase, at the price displayed on the website.  

If the Student does not want to retake the course and chooses to cancel participation in the other courses from the Specialization, ALTOM shall refund the difference between the amount paid for the Specialization and the full price from the website of the followed course/courses. For instance, if you do not complete successfully the BBST® Foundations course after the first try and you decide to cancel the other courses from the package: Refund = Price of the Specialization – Full price (as it is displayed at that moment on the website) for the BBST® Foundations course. 

ALTOM guarantees the quality of the provided service and the good faith in its provision. 

ALTOM does not guarantee the quality of the services provided by the e-learning platform and does not undertake any responsibility regarding the content and the correctness of the information published by it. The members have the obligation to access and read the applicable Policies provided on the e-learning platform. 

ALTOM does not offer any guarantee in case of any consequences that might appear because of the malfunctioning of the services, the delay of the information, or the security of its applications.  

ALTOM commits to remedy as soon as possible the disruptions claimed regarding the functioning of the website. ALTOM, the collaborators, and the content owners cannot be held liable under no circumstances for the consequences generated by the usage of the information/materials existent on the website or requested by other means.  

ALTOM does not guarantee the usage of its services without errors or interruptions. ALTOM does not guarantee and is not responsible for errors, data losses, or delays in their transmission, for the infection of the systems by the visitors with computer viruses or other harmful programs transmitted to the visitors’ systems through the services accessible on https://bbst.courses if they are not the fault of ALTOM. 

ALTOM takes all the reasonable steps to prevent cyber fraud but is not responsible to the Students for the possible damages caused by the third parties’ illegal actions.  

ALTOM has the right to assign its obligations to a third party.  

The Visitor, Client, or Student has the right to fully benefit from the services provided through the website www.bbst.courses in accordance with these T&C.  

 5. Suspension of the access 

Should failure to comply with the usage conditions, ALTOM can cancel, suspend, or limit the Visitor’s, Client’s or Student’s access to the content of the website or e-learning platform or to a part of its content without any further notification or formality and without needing to justify this action. 

6. Force majeure and unforeseeable circumstance

Within the conditions of these T&C, none of the parties shall be responsible for the non-compliance on time and/or inadequately, entirely or partially, with any of the obligations undertaken on the basis of the agreement, if the non-compliance with the respective obligation was caused by a force majeure or an unforeseeable event.  

The following cases shall be considered force majeure: total or partial strikes, the implementation of new legal restrictions, the closing down of the computer systems used by ALTOM or used for compliance with his own obligations, the closing down of the telecommunication means, etc. 

The party or his/her legal representative who invokes one of the aforementioned events is obliged to bring to the other party’s knowledge its occurrence, if possible, immediately and completely, and to take any available measures in order to reduce the consequences of the respective event. The party that invokes the aforementioned event is exempted from the obligation only if it impediments him/her from complying with it. 

If within 15 days from the occurrence of the event, the respective event still makes it impossible to perform the agreement, each party shall have the right to notify the other party regarding the termination of the full right of the agreement, none of the parties being able to claim the other party compensation.  

The party who invokes the force majeure event has to prove the impossibility of complying with the obligations within 30 days from the occurrence of the event.  

 7. Litigations

The provisions of Romanian law are applicable to these terms and conditions, as well as to the agreements concluded between ALTOM and the clients.  

Any conflict that might appear between the Visitor/Client/Student and ALTOM shall be settled amicably. If this is not possible, the conflict shall be settled by the competent court from Romania, at the headquarters of ALTOM, in compliance with the Romanian legislation in force.  

If any of the aforementioned clauses shall be declared null or invalid, regardless of the cause, this fact shall not affect the validity of the other clauses and of the agreement which shall remain in force.  

8. Final provisions

ALTOM reserves the right to be able to make any modifications to the website/its structure/content without prior notification. 

ALTOM reserves the right to introduce any kind of advertising banners and/or connections on any page of the website, in compliance with the legislation in force.
